1. Who we are and what this policy covers
Apify LATAM (“we”, “us”) is a software studio based in San José, Costa Rica. This policy explains how we handle personal information when you visit our sites, contact us, buy or use our products and services, or deal with us as a customer, prospect, vendor, or partner.
It covers the public website, forms, email, phone and other contact channels, the professional work we do, hosting and support we provide, and products or accounts we operate. If a signed contract, accepted proposal, or product terms say something different about a specific processing activity, that document controls for that activity.
2. Information we may collect
We collect what we need to operate, quote, deliver, bill, support, and comply with the law. What we hold depends on how you deal with us.
2.1 Site and contact
When you visit the site or write to us we may process, among other things: name, company, role, email, phone, message, language, country, and technical data about the device or visit (IP address, browser type, pages viewed, traffic source). Forms may include extra fields for a quote, a sales request, or a partnership.
2.2 Commercial relationship and projects
On a quote, contract, or project we may process contact and billing data, organization details, requirements, access you give us, system documentation, and project communications. That can include credentials, configuration copies, or files you send so we can build, connect, or maintain a system.
2.3 Products and accounts
If you use a product, API, or account of ours, we may process account identifiers, usage data, technical logs, payments, and support tied to that account, according to what the product does and what you send us.
2.4 Third-party data you instruct us to handle
In integrations, applications, hosting, or products, you or your systems may give us access to data about your customers, staff, or other third parties. We process that data to provide the service, on your instructions and under the contract. You are responsible for having a lawful basis and the notices and consents that apply.
3. How we use information
We use information to:
- Answer inquiries, quote work, and enter into engagements
- Provide, operate, maintain, and improve sites, software, integrations, hosting, and products
- Invoice, collect, keep accounts, and meet tax duties
- Provide support, security, abuse prevention, and continuity
- Communicate about current work, products, or material changes
- Measure site use and, where applicable, run analytics or advertising
- Comply with law, a valid authority request, or to enforce our rights
4. Processing on a client’s behalf
When we process personal data for a client (for example data that lives in their systems or that flows through an integration), the client determines purposes and means to the extent the law assigns that role. We process the data to perform the engagement, with the measures and subprocessors the work requires.
The client warrants it may give us that data and that its end users receive any notice the law requires. We do not use that data for our own purposes unrelated to the service, except aggregated or anonymized form that does not identify a person, or where the law requires us to.
5. Who we may share information with
We do not sell personal data. We may share it with those needed to operate, and only as far as needed:
- Vendors who provide infrastructure, email, hosting, analytics, payments, accounting, or internal tools
- Third-party platforms or systems you already run or ask us to connect; those parties process data under their own policies
- Professional advisers bound by confidentiality
- Authorities, courts, or third parties when law, a proceeding, or the protection of rights requires it
- An entity that takes on our business or assets, with notice where that is due
6. Cookies and similar technologies
The site may use cookies, pixels, and local storage to function, remember preferences, measure visits, and, where used, advertising. Analytics or advertising third parties may collect information about your visit under their own policies.
You can control cookies in the browser. Blocking them may affect the site. Continued use of the site, with the cookies your browser accepts, is the consent we rely on for these technologies to the extent the law allows.
7. Retention and transfers
We keep information for as long as needed for the purpose that justified it, for legal or accounting periods, or for disputes. We then delete, anonymize, or block it as appropriate.
We may process or host information in Costa Rica or in other countries where we or our vendors operate. By using the site or engaging us, you understand that information may leave your country. We apply the safeguards the matter and the law allow.
8. Security
We apply reasonable technical and organizational measures for the kind of data and service: access limited to the team running the work, authentication where there are accounts, encryption in transit on our sites, and backups where the service includes them. No system is infallible. You must also protect credentials, devices, and what you give us.
9. Your rights
Under applicable law — in Costa Rica, the personal-data protection rules in force — you may request access, correction, deletion, or objection, and any other faculty that law grants you, to the extent they do not conflict with a legal duty or the contract.
To exercise them, write to [email protected]. We will ask for what we need to verify identity. If we only process data as a processor for a client, we may need to send the request to that client.
10. Children
Our sites and services are aimed at organizations and adults. We do not knowingly collect data from children. If you believe a child sent us data, write to us so we can review it.
11. Changes
We may update this policy. The current version is the one published on this page, with the last-updated date. Later use of the site or the services, where the law allows, means you have notice of the new version. If a change is material and the law requires notice, we will give it by a reasonable means.
